Terms and Conditions

These Terms and Conditions explain how BW Broadband provides services and how you may use them. By ordering, activating, or using our services, you agree to these Terms.

1) Definitions

  • Company means BW Broadband and its affiliates, including Blanchard Telephone when applicable.

  • Service means internet access and any add-ons such as managed Wi-Fi, static IPs, or voice services.

  • Customer means the account holder who orders or uses the Service.

2) Eligibility and Service Availability

Service availability depends on your location, network facilities, credit approval, and equipment. The Company may accept or decline any order. Some speeds or features are not available in all areas.

3) Account Registration and Security

You must provide accurate information and keep it current. You are responsible for the activity on your account and for keeping passwords safe. The Company may require a deposit or credit check.

4) Plans, Pricing, and Billing

  • Billing cycle: Monthly in advance for recurring charges. Taxes, fees, and surcharges may apply.

  • Payment: Due by the date on your invoice. Late payments may incur a late fee and service suspension.

  • Price changes: The Company may change prices or plan details. We will provide reasonable notice as required by law.

  • Promotions: Introductory or promotional rates may have conditions or expiration dates.

  • Third-party charges: Services from third parties, such as streaming apps, are billed separately by those providers.

5) Installation, Access, and Equipment

  • Access: You authorize the Company and its contractors to access your premises to install, maintain, or remove equipment. A person 18 or older must be present.

  • Company equipment: Modems, gateways, routers, and other devices that we provide remain the property of the Company unless stated otherwise. You must return Company equipment in good working order when service ends. Unreturned or damaged equipment may result in a charge.

  • Customer equipment: You are responsible for compatible devices and home wiring. The Company is not responsible for damage to customer-owned equipment unless caused by the Company’s negligence.

6) Internet Performance and Network Management

  • Speeds: Advertised speeds are maximums and are not guaranteed. Actual speeds vary due to network conditions, device performance, Wi-Fi congestion, and other factors.

  • Data usage: Unless a plan states otherwise, service is not metered. The Company may use reasonable network management to ensure a good experience for all customers.

  • Security: Use antivirus, firewalls, and strong passwords. The Company does not guarantee that the Service will be free from viruses or intrusions.

7) Acceptable Use Policy

You agree not to use the Service for unlawful activity, to infringe intellectual property, to send spam, to run open proxies, or to interfere with the network or other users. You agree not to attempt to bypass security or to resell the Service without written consent. The Company may suspend or terminate Service to protect the network or to address violations.

8) Prohibited Content and Copyright

Customers must respect copyrights. If the Company receives a valid notice under the Digital Millennium Copyright Act (DMCA), it may remove or disable access to material and may notify the customer. Repeat infringements may lead to termination.

9) Dynamic and Static IP Addresses

Residential service generally uses dynamic IP addressing. Static IPs are available on eligible plans for an additional fee. IP addresses are not portable and may change.

10) Service Interruptions and Maintenance

Planned maintenance or unplanned outages may occur. The Company aims to restore service promptly. Credits for extended outages may be offered as a bill adjustment at the Company’s discretion and only upon request. Credits do not apply to power failures at the customer premises or issues with customer equipment.

11) Managed Wi-Fi and Inside Support (if purchased)

Managed Wi-Fi includes router configuration and basic optimization. Mesh units may be available for an additional fee. The Company does not guarantee Wi-Fi coverage in all areas of a building. Building materials and device limits affect performance.

12) Voice Services and 911 (if applicable)

  • E911: Voice over internet service relies on power and broadband connectivity. If power or broadband is out, 911 may not work. Keep backup power if the location requires continuous phone access.

  • Location: You must keep your service address current so that 911 calls are routed correctly.

  • Features and devices: Some alarm systems, medical monitors, fax machines, and credit card terminals may not work with VoIP. Test before relying on them.

13) Term, Renewal, and Cancellation

  • Term: Some plans require a 12-month agreement. Others are month to month. Your order confirmation shows the term.

  • Early termination: If you cancel during a fixed term, an early termination charge may apply and unreturned equipment fees may be billed.

  • How to cancel: Contact Customer Support at [phone] or [email]. You are responsible for all charges through the end of the current billing period unless the law states otherwise.

14) Privacy

The Company collects and uses information as described in the BW Broadband Privacy Policy. Network management data and aggregated usage statistics may be used to operate and improve the Service. The Company does not sell personal information to third parties.

15) Warranties and Disclaimers

The Service is provided as is and as available. The Company disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The Company does not warrant that the Service will be uninterrupted, error free, or secure.

16) Limitation of Liability

To the fullest extent allowed by law, the Company is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, even if advised of the possibility. The total liability for any claim is limited to the amount you paid for the Service during the one month before the claim arose. These limits do not apply to personal injury caused by the Company’s negligence or to willful misconduct.

17) Indemnification

You agree to indemnify and hold the Company, its affiliates, officers, employees, and contractors harmless from claims, losses, and expenses, including attorney fees, that arise from your use of the Service or your breach of these Terms.

18) Changes to the Service or to These Terms

The Company may change the Service and these Terms. If a change materially affects you, the Company will provide notice as required by law. Your continued use of the Service after the effective date means you accept the change.

19) Assignment

You may not transfer your rights or duties under these Terms without our written consent. The Company may assign these Terms to an affiliate or a successor.

20) Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to conflict of law rules. Disputes will be resolved in the state or federal courts located in Michigan, unless the parties agree to arbitration. You and the Company consent to personal jurisdiction in those courts.

21) Severability

If any part of these Terms is found invalid, the rest remains in effect.
